On February 1, 2016, John D. Smith (plaintiff) filed a lawsuit against the City of Clarity Falls alleging that city inappropriately destroyed several records in violation of state law. Mr Smith also obtained an order from the court directing the City Water Department to release any and all emails in its possession regarding its 2015 decision to source water from the FullaCahCah Creek as opposed to Lake Erie. Mr. Smith had originally asked for any and all project records, EPA submissions and emails regarding the project 6 months earlier due to his concern that a water contamination incident similar to Flint Michigan was occurring in Ohio.
